If your accident is recent, you may

After a physician has treated you
for a while, they may request that you have an MRI, nerve
conduction test, physical therapy, epidural steroid injections,
PET scan, occupational therapy or any number of other diagnostic

undertaken with the defense attorney or insurance adjuster. If a

check or settlement documents.
Sometimes mediation is advantageous
toward achieving a fair settlement. During mediation the injured
person and attorney are in one location while the defense
attorney and adjuster are in another. A person, designated by a
mediator, goes from one to another with messages and offers of
settlement. Many times a monetary figure is obtained which both
sides deem acceptable. An advantage to mediation is that a
trial is unnecessary and the client is usually paid in about
two weeks.
Sometimes no settlement is reached
and it is necessary to proceed to court. On average, this
happens in 10% of cases. Cases are tried either to a judge or jury.

After trial, one side or the other

decision by that Court, clients involved by it may ask the
Louisiana Supreme Court to consider their case. This is known as
"taking a writ" and that Court has the discretion to consider
each case or refuse to do so.
